General sale conditions

Every order of products distributed by pieces-mz.com implies the acceptance without reservations of the sale conditions hereunder in its entirety. These rules cancel any other different or opposite clause, appearing on the customer’s documents or correspondence.  The present contract will be ruled by French Law. The courts of the home office of pieces-mz (Blois) are the only ones qualified.

Order taking

The information stated by the buyer, commits this later: in case of error in the wording of the coordinates of the recipient, the seller should not be held responsible for the impossibility in which he could be to deliver the product and the buyer will have to settle a second delivery charge identical to the first one, all remittance excluded, if the seller has to resend it. The orders are finals only when they are confirmed by the settlement of the price by the buyer.

- All check settlement brings on a cashing period of 14 days, starting on the day of the deposit of the check at the bank by ourselves – this in order to avoid unpaid checks. During that period, the merchandise is reserved, but will not be sent.

- In case of transfer settlement, the merchandise will be sent the day of the arrival of the funds on our account. In order to avoid that the merchandise remains on sale, we invite you to send us a copy of the transfer receipt that was delivered by your bank on the day of the transfer.

All our offers are meant in the limit of available stock without commitment other than the sale.
Considering the nature of certain products, restrictions on available quantities can be applied. Pieces-mz.com reserves the right to deny an order in cases of large quantity orders.  

Guaranties

We sell two types of merchandise:

-        New parts
-        used parts

New parts

New parts are guaranteed 12 months return to the workshop, under the conditions and providing they have been assembled by a professional in the rules of the art, assembly invoice provided as support, and they have been used only in normal conditions and on unmodified vehicles, as they were intended and delivered by the manufacturer.

Used parts

Used parts are guaranteed 3 months return to the workshop, under the conditions and providing they have been assembled by a professional in the rules of the art, assembly invoice provided as support, and they have been used only in normal conditions and on unmodified vehicles, as they were intended and delivered by the manufacturer.

Any merchandise being sent back unjustifiably (damages excluded from the guarantee, products in working conditions, reference error in the order) will involve the invoicing of the return transport BEFORE the merchandise can be sent back.

Delivery

Pieces-mz.com commits to doing everything in order to deliver the ordered products in the fastest delays.

Delivery is made in the scheduled delay by the direct remittance of the product to the announced recipient, or in case of absence, by the notification of availability. Eventual delays do not give the right to the buyer to cancel the sale, to refuse the merchandise or to claim damages and interests. Are considered cases of major force discharging the seller of its obligation of delivering, war, riot, fire, strikes, accidents and impossibility to be supplied.  Merchandise always travels at the risk and peril of the recipient. Always verify your package upon arrival. You must make eventual claims with the transporter in case of failure or degradation on delivery. All damages or failures not notified on transport documents are not dealt with by pieces-mz.com.

Withdrawal option

In accordance with the Consumption Code, the Customer disposes of seven days (7 days) to withdraw himself. This delay runs starting from the reception of the Product, when it is a property, and up to the conclusion of the contract when the Product is a service.

The Customer will not be able to prevail himself of this right in the following situations:

• The supplying of a service for which the execution has started or was integrally completed before the end of the seven days delay.
• The supplying of property which by their nature cannot be resent or are susceptible to deteriorate or to perish rapidly.  

The Customer exercises this withdrawal option without having any motive to give, or any penalty to pay. On the other hand, the direct resending costs of the merchandise are at his expense and the product must be in its original packaging, not deteriorated.  

Price

The price indicated on the product cards does not include the transport. The price indicated in the order confirmation by pieces-mz.com is the final price, expressed with all taxes included and including the Sales Tax of 19.6 % for France. This price includes the price of the products, the handling charges, packaging and conservation of the products and the transport. The prices indicated mean all taxes included (ATI price, except typographic error) Metropolitan France (Corse included) (Sales Tax of 19.6 %) transport excluded.

Custom duties or other local taxes are susceptible to be required. These duties and totals do not fall under the competence of pieces-mz.com. They will be payable by you and will be your responsibility in terms of declaration as well as in terms of payments to the local competent authorities and organisations of your country. We suggest that you inquire on these aspects with your local authorities.

All the orders wherever they are from are payable in Euros (the effective rate of the euro is set at 6.55957 FF). The price is expressed in Euro; the amounts expressed in other monies are only mentioned as an indication. The company reserves the right to modify its prices at any time but the products will be invoiced on the basis of the effective rates at the moment or the recording or the orders.  

Payment

The settlement of the products can be made by check, by bank card or by bank transfer. The company pieces-mz.com will establish for any delivery a corresponding invoice to the products delivered as established by pieces-mz.com and sent to the client at his invoicing address, in the merchandise package. The products remain the ownership of pieces-mz.com up to the complete settlement of the invoices.  

Litigations

The claims or disputes will always be received with favourable consideration, the good faith being always presumed of one who takes the time to expose the situations. In case of disputes, the customer will address himself by priority at the company to obtain an amicable resolution. Failing this, the Trading Court of de Blois is the only competent, whatever the delivery locations are and the payment mode accepted.
